Daño (Derecho)

Damage is detriment, prejudice or impairment caused by fault of another in the patrimony or the person. In civil law, the word "damage" means the detriment, damage or impairment that a person suffers as a result of the action or omission of another, and that affects his property, rights or interests. The branch of civil law that deals with damages is the so-called law of civil liability. A certain branch of the doctrine misleadingly refers to this branch of study as a "right of harm" in rendering a crude translation of the term "Tort Law". However, the error is not limited to the nominal aspect because it also reaches the analysis perspective used. The damage can be caused by intent or guilt, or it may be due to a fortuitous event or force majeure. In the case of malicious damage, the perpetrator acts intentionally or maliciously. In the case of damage caused by wrongdoing, the conduct is negligent, sloppy or unforeseeable, and does not provide the attention it should according to the applicable canon or standard of care. In principle, the intentional damage obliges the author of the damage to compensate it. Daño es el detrimento, perjuicio o menoscabo causado por culpa de otro en el patrimonio o la persona. En Derecho civil, la palabra "daño" significa el detrimento, perjuicio o menoscabo que una persona sufre a consecuencia de la acción u omisión de otra, y que afecta a sus bienes, derechos o intereses. La rama del Derecho civil que se ocupa de los daños es el llamado Derecho de la responsabilidad civil. Cierto sector de la doctrina denomina de modo equívoco a esta rama de estudio como "Derecho de daños" al efectuar una traducción tosca del término "Tort Law". Sin embargo, el error no se limita al aspecto nominal pues también alcanza a la perspectiva de análisis empleado. El daño puede ser causado por dolo o culpa, o bien puede deberse a caso fortuito o fuerza mayor. En el caso de daño doloso, el autor del daño actúa de forma intencional o maliciosa. En el caso de daño causado culposamente, la conducta es negligente, descuidada o imprevisora, y no presta la atención que debiera según el canon o estándar de diligencia aplicable. En principio, el daño doloso obliga al autor del daño a resarcirlo.
