Cuando es un recluta, no es un desertor, sino un prófugo. Se aplica el Derecho militar –por ejemplo, el Código de Justicia Militar– al militar que ocasione deserción, y suele considerarse un delito, y muy grave en tiempos de guerra. En esa situación se les exige presentarse ante un Consejo de guerra, Corte marcial o Tribunal de justicia, siendo eventualmente objeto de una sanción penal, que puede llegar hasta la pena de muerte.
