Ostracisme (Grèce antique)
Ostracism was a vote by which Ecclesia pronounced the banishment of one of its citizens, whose name was inscribed on a ceramic. This was cut in half and at the end of the period of exile, the two sherds were united. During the period of banishment, Ecclesia preserved these shards, ostraca, in which the names of the exiles appeared. Athens and some other cities, in the 5th century BC. BC, established an institution that allowed a citizen to be banished for ten years without losing his property. It was a measure of political expulsion, a mere vote of no confidence in an influential citizen suspected of aspiring to personal power: it was not a judicial punishment, not a criminal conviction : it was not accompanied by pecuniary punishment, and civil rights were retained. This important institution appears to be characterized by a spirit of humanity both in the procedure followed and in the sentence handed down. L’ostracisme était un vote par lequel l'Ecclésia prononçait le bannissement de l'un de ses citoyens, dont le nom était inscrit sur une céramique. Celle-ci était coupée en deux et à l'issue de la période d'exil, les deux tessons étaient réunis. Durant la période de bannissement, l’Ecclésia conservait ces tessons, ostraca, où figuraient les noms des exilés. Athènes et quelques autres cités, au Ve siècle av. J.-C., ont instauré une institution qui permettait de bannir pendant dix ans un citoyen, sans que celui-ci perdît ses biens. C'était une mesure d'éloignement politique, un simple vote de défiance à l'égard d'un citoyen influent soupçonné d'aspirer au pouvoir personnel : ce n'était pas une peine judiciaire, cette sanction n'étant pas une condamnation pénale : elle ne s'accompagnait pas de peine pécuniaire, et les droits civiques étaient conservés. Cette importante institution apparaît donc marquée d'un esprit d'humanité tant dans la procédure suivie que dans la peine prononcée.
