A petition or complaint is one of the fundamental rights of the people, which refers to acts and forms in which a citizen advocates complaints or wishes to the state and demands correction. Citizens can petition for any illegal act or unfairness of the state, irrespective of whether the infringement has occurred or not. However, interfering with the trial or blaspheming the head of state is excluded. The Constitution states that 'every citizen shall have the right to petition to the national institution in writing, as the Act requires'. In addition, the state has the obligation to review the petition, and it guarantees the petition as one of the fundamental rights of the people.

청원 또는 진정서는 국민의 기본권 중 하나로 국민이 국가에 대하여 불만 또는 희망사항을 개진하고 시정을 요구하는 행위와 그 서식을 말한다. 국민은 국가작용의 위법, 부당에 대해서 또한 권익침해의 발생 여부와 행해진 시점에 관계 없이 언제라도 청원할 수 있다. 그러나 재판에 간섭하는 것이나 국가원수를 모독하는 것은 제외된다. 헌법은 '모든 국민은 법률이 정하는 바에 의하여 국가기관에 문서로 청원할 권리를 가진다'. '또한, 국가는 청원에 대하여 심사할 의무를 진다.'라고 규정하여 청원을 국민의 기본권의 하나로 보장하고 있다.
