In civil law, an agent is a person who makes decisions by himself / herself, and is different from a lion who simply delivers and completes his / her own opinions. Also, the act of the agent is different from the representative of the corporation, which is the act itself of the corporation because the effect is attributed to the person. There are two types of agents in civil law: legal representatives and arbitrators. The agent needs to have doctor 's ability because he or she makes a doctor' s declaration, but the effect of the act is self - imposed and incompetent because the agent does not suffer disadvantage. In many cases, the Civil Act stipulates a special provision that prohibits persons with incapacity from becoming legal representatives in order to protect their interests. In the administrative law, there is a relationship in which an agent is created between administrative bureaus, and the whole or a part of the authority of the administrative bureau is exercised by the subsidiary agency or other bureau as the agent of the bureau. .

민법상 대리인은 스스로 의사를 결정하여 표시하는 자이므로 단순히 본인의 의사를 전달, 완성시키는 사자와는 다르다. 또한 대리인의 행위는 그 효과가 본인에게 귀속하므로 법인의 행위 그 자체로 되는 법인의 대표와도 다르다. 민법상 대리인에는 법정대리인·임의대리인의 두 종류가 있다. 대리인은 스스로 의사표시를 하기 때문에 의사능력이 있음을 필요로 하지만 그 행위의 효과는 본인에게 귀속하고 대리인이 불이익을 받는 일이 없기에 무능력자라도 무방하다. 민법은 본인의 이익을 보호하기 위하여 무능력자가 법정대리인이 되는 것을 금지하는 특칙을 정하는 경우가 많다. 행정법상으로는 행정관청 상호간에 대리인이 발생되는 관계가 있는데 행정관청 권한의 전부나 일부를 그 보조기관이나 다른 관청이 피대리 관청의 대리인으로서 행사하여 그 대리인의 행위가 피대리관청의 행위로서의 효력을 발생하는 것이다.
