Franchising, franchising or franchising is a management strategy that has as its purpose a franchise system in which the franchisor grants the franchisee the right to use his trademark, patent, infrastructure, know-how and exclusive or semi-exclusive distribution of products or services. The franchisee, in turn, invests and works on the franchise and pays part of the billing to the franchisor in the form of royalties. Eventually, the franchisor also assigns to the franchisee the right to use technology for the implementation and administration of business or systems developed or held by the franchisor, for direct or indirect remuneration, without being characterized employment relationship. It is mandatory to submit a franchise circular by the franchisor, indicating the general conditions of the legal transaction. While enabling faster return, buying a franchise generally requires a high initial investment, since you need to plan installation, equipment, and personnel costs.

Franquia, franchising ou franchise é uma estratégia utilizada em administração que tem, como propósito, um sistema de venda de licença na qual o franqueador cede, ao franqueado, o direito de uso da sua marca, patente, infraestrutura, know-how e direito de distribuição exclusiva ou semiexclusiva de produtos ou serviços. O franqueado, por sua vez, investe e trabalha na franquia e paga parte do faturamento ao franqueador sob a forma de royalties. Eventualmente, o franqueador também cede ao franqueado o direito de uso de tecnologia de implantação e administração de negócio ou sistemas desenvolvidos ou detidos pelo franqueador, mediante remuneração direta ou indireta, sem ficar caracterizado vínculo empregatício. É obrigatória a apresentação de uma circular de franquia pelo franqueador, indicando as condições gerais do negócio jurídico.
