En la jurisprudencia, una excusa o justificación es una defensa a cargos criminales que es distinta de una exculpación. Exculpación es un concepto relacionado que reduce o extingue la culpabilidad de una persona y por lo tanto la responsabilidad de una persona para pagar una indemnización a la víctima de un delito civil. La "excusa" proporciona un factor atenuante para un grupo de personas que comparten una característica común. Justificación, como en homicidio justificable, reivindica o muestra la justicia. Por lo tanto, la sociedad aprueba el propósito o motivos que sustentan algunas acciones o las consecuencias que derivan de ellas, y distingue aquellas en las que el comportamiento no puede ser aprobado, pero alguna excusa puede encontrarse en las características del demandado, p. Thus, a justification describes the quality of the act, whereas an excuse relates to the status or capacity in the accused. These factors can affect the resulting judgment which may be an acquittal, or in the case of a conviction may mitigate sentencing.
