Un fatwā dans la foi islamique est le terme pour l'opinion juridique ou l'interprétation savante qu'un juriste qualifié ou mufti peut donner sur des questions relatives à la loi islamique. La personne qui émet un fatwa s'appelle, à cet égard, un Mufti, c'est-à-dire un émetteur de fatwā, du verbe أفتى 'aftā = "il a donné un avis juridique formel sur". Ce n'est pas nécessairement une position formelle car la plupart des musulmans soutiennent que toute personne formée à la loi islamique peut donner son opinion sur ses enseignements. Si un fatwā ne relève pas un nouveau terrain, on appelle simplement une décision. Une analogie pourrait être faite à la question des avis juridiques des tribunaux dans les systèmes de common law. Les Fatwās contiennent généralement les détails du raisonnement du savant, généralement en réponse à un cas particulier, et sont considérés comme un précédent contraignant par les musulmans qui se sont liés à ce savant, y compris les futurs muftis; Les simples décisions peuvent être comparées aux avis de mémorandum.

A fatwā in the Islamic faith is the term for the legal opinion or learned interpretation that a qualified jurist or mufti can give on issues pertaining to the Islamic law. The person who issues a fatwā is called, in that respect, a Mufti, i.e. an issuer of fatwā, from the verb أَفْتَى 'aftā = "he gave a formal legal opinion on". This is not necessarily a formal position since most Muslims argue that anyone trained in Islamic law may give an opinion on its teachings. If a fatwā does not break new ground, then it is simply called a ruling. An analogy might be made to the issue of legal opinions from courts in common-law systems. Fatwās generally contain the details of the scholar's reasoning, typically in response to a particular case, and are considered binding precedent by those Muslims who have bound themselves to that scholar, including future muftis; mere rulings can be compared to memorandum opinions.
