Dalam undang-undang, kes yang dinyatakan adalah prosedur yang mana mahkamah atau tribunal boleh meminta mahkamah lain untuk pendapatnya pada titik hukum. Terdapat dua jenis: kes rundingan yang dinyatakan dan merayu dengan cara yang dinyatakan. Kes rundingan yang dinyatakan dibuat mengikut budi bicara hakim sebelum dia menentukan kes itu di hadapan mahkamah. Rayuan melalui kes yang dinyatakan dibuat atas permintaan pihak kepada prosiding kepada hakim selepas kes selesai. Pada pendengaran kes menyatakan mahkamah yang lebih tinggi adalah terhad kepada pertimbangan undang-undang sahaja dan dikehendaki menerima pernyataan fakta yang dikemukakan kepadanya oleh mahkamah rendah. Jika permohonan itu diberikan, perkara itu dirujuk ke mahkamah yang lebih tinggi. Ini biasanya mengambil bentuk "adakah kami / saya membetulkan ..." dan kemudian aspek undang-undang yang dinyatakan di mana rayuan itu berkaitan. Sekiranya permohonan menyatakan kes tidak ditolak pemohon boleh mendapatkan peninjauan semula oleh semakan kehakiman. Mahkamah Tinggi akan menentukan sama ada undang-undang telah digunakan dengan betul atau tidak. Jika rayuan dipertahankan, Mahkamah Tinggi akan merujuk kes itu kembali ke mahkamah majistret yang berkenaan dengan arahan untuk membetulkan keputusannya.
