A Primeira Emenda à Constituição dos Estados Unidos proíbe a promulgação de qualquer lei relativa a um estabelecimento de religião, impedindo o livre exercício da religião, abrindo a liberdade de expressão, violando a liberdade de imprensa, interferindo no direito de reunir ou proibir pacificamente a petição para uma reparação governamental de queixas. Foi adotado em 15 de dezembro de 1791 como uma das dez emendas que constituem a Declaração de Direitos. O Bill of Rights foi originalmente proposto como uma medida para aliviar a oposição anti-federalista à ratificação constitucional. Inicialmente, a Primeira Emenda aplicava-se apenas às leis promulgadas pelo Congresso, e muitas das suas disposições foram interpretadas de forma mais restrita do que hoje. Começando com Gitlow v. Nova York, o Supremo Tribunal aplicou a Primeira Emenda aos estados - um processo conhecido como incorporação - através da Cláusula do Debido Processo da Décima Quarta Emenda. Em Everson v. Board of Education, o Tribunal utilizou a correspondência do fundador Thomas Jefferson para pedir "uma parede de separação entre igreja e estado", embora o limite preciso desta separação continue em disputa.
