আইন অনুযায়ী, একটি মামলা বলা হয়েছে এমন একটি পদ্ধতি যার দ্বারা একটি আদালত বা ট্রাইবু্যনাল আরেকটি আদালতের আইন সম্পর্কে তার মতামত জানতে পারে। দুই ধরণের আছে: পরামর্শমূলক কেস বিবৃত এবং মামলার উপায় দ্বারা আপীল বিবৃত। আদালতের সামনে কেসটি নির্ধারণের আগে একটি পরামর্শমূলক মামলাটি বিচারকের বিবেচনার ভিত্তিতে তৈরি করা হয়েছে। একটি মামলার উপসংহার পরে বিচার বিভাগের বিচারের জন্য একটি পক্ষের অনুরোধে বিবৃত মামলার উপায় দ্বারা একটি আপিল করা হয়। একটি মামলার শুনানিতে বলা হয় যে উচ্চ আদালত শুধুমাত্র আইন বিবেচনায় সীমাবদ্ধ এবং নিম্ন আদালতের কাছে জমা দেওয়া ঘটনাগুলির বিবৃতি গ্রহণ করতে হবে। যদি আবেদনটি মঞ্জুর হয়, তবে বিষয়টি উচ্চ আদালতকে বলা হয়। এটি সাধারণত "আমরা / আমরা ছিল সঠিক ছিল" ফর্ম নেয় এবং তারপর আইনটির নির্দিষ্ট দিক যা আপীল সম্পর্কিত হয়। যদি আবেদনকারীকে আবেদন করার আবেদনটি প্রত্যাখ্যান করা হয়, তাহলে আবেদনকারী বিচারিক পর্যালোচনা দ্বারা প্রতিকার চাইতে পারে। আইনটি যথাযথভাবে প্রয়োগ করা হয়েছিল কি না তা হাইকোর্ট নির্ধারণ করবে। আপিল আপিল করা হলে, হাইকোর্ট যথাযথ ম্যাজিস্ট্রেট আদালতে মামলাটি পুনর্বিবেচনার সিদ্ধান্তের সাথে উল্লেখ করে।

In law, a case stated is a procedure by which a court or tribunal can ask another court for its opinion on a point of law. There are two kinds: consultative case stated and appeal by way of case stated. A consultative case stated is made at the discretion of a judge before he or she determines the case before the court. An appeal by way of case stated is made at the request of a party to the proceedings to the judge after the conclusion of a case. On the hearing of a case stated the higher court is restricted to consideration of the law alone and is required to accept the statement of facts submitted to it by the lower court. If the application is granted, the matter is referred to the higher court. This usually takes the form "were we/was I correct to..." and then the specified aspect of law to which the appeal relates. If the application to state a case is refused the applicant could seek redress by judicial review. The High Court will determine whether or not the law was correctly applied. If the appeal is upheld, the High Court will refer the case back to the appropriate magistrates' court with directions to correct its decision.
