Nach der Verfassung von Afghanistan von 1964 sind alle Afghanen in Bezug auf Rechte und Pflichten vor dem Gesetz gleich. Der vierte Artikel der gegenwärtigen Verfassung von Afghanistan besagt, dass die Bürger von Afghanistan aus Paschtunen, Tadschiks, Hazara, Usbekistan, Turkmenen, Aymaq, Araber, Baluch, Paschayi, Nuristani, Qezelbash, Gujjars, Brahui und Mitgliedern anderer Stämme bestehen.
