Gemeinsames Recht ist Gesetz, das von Richtern durch Entscheidungen von Gerichten und ähnlichen Gerichten entwickelt wird, im Gegensatz zu den Statuten, die durch den Gesetzgebungsprozess oder die von der Exekutive ausgegebenen Verordnungen angenommen wurden. Ein "Common Law System" ist ein Rechtssystem, das dem Common Law ein gutes vorrangiges Gewicht verleiht, auf dem Grundsatz, dass es unfair ist, bei verschiedenen Anlässen ähnliche Fakten unterschiedlich zu behandeln. Der Präzedenzfall heißt "gemeinsames Recht" und bindet künftige Entscheidungen. In Fällen, in denen die Parteien nicht einverstanden sind, was das Gesetz ist, sieht ein gemeinsames Rechtsgericht vorübergehende Entscheidungen der zuständigen Gerichte vor. Wenn ein ähnlicher Streit in der Vergangenheit gelöst worden ist, ist das Gericht in der Regel verpflichtet, die in der vorherigen Entscheidung verwendete Begründung zu befolgen. Wenn jedoch das Gericht feststellt, dass der gegenwärtige Streit grundsätzlich von allen früheren Fällen verschieden ist, haben die Richter die Befugnis und die Pflicht, Gesetz zu schaffen, indem sie Präzedenzfall schaffen. Danach wird die neue Entscheidung Präzedenzfall und wird künftige Gerichte binden. In der Praxis sind gemeinsame Rechtssysteme wesentlich komplizierter als das oben beschriebene vereinfachte System.
