Family law is a law that regulates the succession of property based on the family life and the common life of family and relatives. The term kinship / inheritance law is sometimes used. In the case of the Republic of Korea, it is referred to as "Family Law" as a bundle of the second and third bonds in the Civil Code, the Property Law, and the fourth and fifth inheritance. . The property law and the family law are both civil law and have the same property in the sense of discipline of the life relation of mankind. The social life of the civil law, which is subject to discipline, is divided into two aspects: the aspect of economic life, which is the life of production and reproduction of goods, and the aspect of family and relatives' living together, . The kinship law has a non-antagonistic and irrational nature, and the property law has a different and reasonable character. The law of property is generally 'arbitrary law', whereas the family law is in principle 'law enforcement.'

가족법은 가족 및 친족의 공동생활과 공동생활에 기초한 재산의 승계관계를 규율하는 법이다. 친족·상속법이라는 용어를 사용하기도 한다. 대한민국의 경우, 민법전 가운데에서 제2편 물권, 제3편 채권을 한 묶음으로 해서 '재산법'이라고 하고, 제4편 친족과 제5편 상속을 한 묶음으로 해서 '가족법'이라고 강학상 일컬어지고 있다. 재산법과 가족법은 모두 민법으로서 인류의 생활관계를 규율하는 의미에서 동일한 성질을 가지고 있다. 민법이 규율의 대상으로 하고 있는 인간의 사회생활은 재화의 생산·재생산의 생활인 '경제생활의 면'과 종족의 생산·재생산의 생활인 가족적·친족적 '공동생활의 면'이라는 두 가지 면으로 나누어 볼 수 있다. 친족법은 비타산적·비합리적 성질을 지니고, 재산법은 타산적·합리적 성격을 지닌다. 재산법은 대체로 '임의법'인데 비하여 친족법은 원칙적으로 '강행법'이다.
