Attracting emotions
Emotional appeal means a forced disposition to bring a defendant or a suspect in a hospital or other appropriate place for a certain period of time to assess the mind or body of the defendant or the suspect. The prosecutor shall demand the judge to bring in the emotions when it is necessary to attract the emotions. Since the emotional appeal also has a meaning of restraint in practice, the provisions of the Criminal Procedure Law shall be applied mutatis mutandis. Accordingly, notice of the defendant's case and defense attorney's right, disclosure of the reason for detention, cancellation of detention, suspension of enforcement is performed according to the regulations.
