A certified real estate agent is a person who has obtained the status of a registered public official in accordance with the Act on the Notification of Work and Real Estate Transactions of Certified Realtor. The law stipulates that the real estate brokerage law refers to specialist brokers who operate brokering of land, buildings, land, fixtures and fittings, mining foundations and factory foundations. 공인중개사는 공인중개사의 업무 및 부동산거래신고에 관한 법률에 따라 공인중개사 자격을 취득한 자를 말한다. 공인중개사법으로는 토지·건물·토지의 정착물·입목, 광업재단·공장재단의 중개를 영업으로 하는 전문중개업자를 칭하는 것으로 명시하였다. 대한민국 행정부는 부동산중개업자의 공신력을 높이고 공정한 부동산거래질서를 확립한다는 입법취지로,1983년 제정의 부동산중개업법에 의해 처음으로 법률상 그 이름을 만들었다.공인중개사 시험은 1·2차로 나누어 1차시험에 부동산학개론·민법을, 2차시험에 공인중개사의 업무 및 부동산 거래신고에 관한 법령 및 중개실무, 부동산공시에 관한 법령, 부동산에 관련된 세법, 부동산에 관련된 공법을 치러야 한다. 1차 평균 60점이상, 2차 평균60점이상이며, 1과목이라도 40점미만일 경우 과락으로 불합격된다. 또한 1차과목이 불합격인 경우, 2차과목이 아무리 합격점을 넘었더라도 불합격으로 처리된다.
