국제거래법
The international trade law means that an internationally recognized commercial practice is in the form of a law. If the contract is crossed over the border, the question arises as to which country's contract law will apply. This problem can be solved by determining the governing law under the international law, but there are cases in which the contract law of one country can not be understood properly by another country. For example, transactions occur between the Anglo-American and Continental states. The fact that there is no such unified contract law itself is a big obstacle to the transaction. If there is no unified contract law, the contents of the contract relationship and the legal consequences of the dispute can not be predicted. Uncertainty hinders the transaction itself. Therefore, the need for a uniform contract law in international transactions has always been raised. A typical effort is the United Nations Convention on Contracts for the International Sale of Goods. This agreement is limited to the contract of sale of the goods. 국제거래법은 국제적으로 승인된 상관습이 법의 형태로 된 것을 말한다.계약이 국경을 넘어 이루어지는 경우에는 어느 국가의 계약법이 적용될 것인가 하는 문제가 발생한다. 이러한 문제는 국제사법에 의해서 준거법을 결정함으로써 해결될 수 있지만, 한 나라의 계약법을 다른 나라 사람이 제대로 알 수 없는 경우도 있다. 예를 들면 영미법국가와 대륙법국가 사이에 거래가 이루어지는 경우가 그러하다. 이와 같이 통일된 계약법이 존재하지 않는다는 것 자체가 거래에 커다란 걸림돌이 된다. 통일된 계약법이 존재하지 않는다면 계약관계의 내용과 발생한 분쟁의 법적 결과 등을 예측할 수 없기 때문이다. 불확실성은 거래 그 자체를 방해하게 된다. 따라서 국제적인 거래에 있어서 통일된 계약법의 필요성은 항상 제기되어 왔다. 대표적인 노력의 산물이 국제 물품 매매 계약에 관한 국제 연합 협약이다. 이 협약은 물건의 매매계약에 한정된다.
