Opinión concurrente

En la ley, una opinión concurrente es una opinión escrita de uno o más jueces de un tribunal que está de acuerdo con la decisión tomada por la mayoría del tribunal, pero establece diferentes razones como base para su decisión. Cuando ninguna mayoría absoluta del tribunal puede llegar a un acuerdo sobre la base para decidir el caso, la decisión del tribunal puede estar contenida en una serie de opiniones concurrentes y la opinión concurrente unida por el mayor número de jueces se conoce como la opinión de la pluralidad . En la práctica, las opiniones concurrentes son ligeramente menos útiles para los abogados que las opiniones mayoritarias. No habiendo recibido la mayoría de los votos de la corte, las opiniones concurrentes no son precedentes vinculantes y no pueden ser citadas como tales. Pero las opiniones concurrentes a veces pueden ser citadas como una forma de precedente persuasivo. El conflicto de opiniones entre una opinión mayoritaria y una opinión concurrente puede ayudar a un abogado a comprender los puntos de derecho articulados en la opinión de la mayoría.
