Caso dichiarato
In diritto, un caso è una procedura con cui un tribunale può chiedere un altro tribunale per il suo parere su un punto di diritto. Esistono due tipi: il caso consultivo e il ricorso per caso indicati. Un caso consultivo è fatto a discrezione di un giudice prima di determinare il caso dinanzi al giudice. Su richiesta di una parte del procedimento al giudice, dopo la conclusione di un caso, viene presentato un ricorso per caso. All'udienza di un caso affermato il giudice superiore è limitato alla sola considerazione della legge e deve accettare la dichiarazione dei fatti sottoposta dal tribunale inferiore. Se la domanda è concessa, la questione viene rinviata al tribunale superiore. Ciò normalmente assume la forma "siamo stati / sono stati corretti a ..." e poi l'aspetto specifico della legge a cui si riferisce l'appello. Se la domanda di dichiarazione di un caso è rifiutata, il richiedente potrà chiedere il ricorso mediante revisione giudiziaria. La Corte Suprema determinerà se la legge sia corretta o meno. Se il ricorso è accolto, la High Court rinvia il caso al tribunale giudice competente con indicazioni per correggere la sua decisione.
