L'interpretazione intesa è stata introdotta come una forma di rimpiazzo per la regola di malizia, la regola di significato semplice e la regola d'oro per determinare i casi. L'interpretazione intesa è esercitata quando i tribunali utilizzano materiali estranei dalla fase di pre-attuazione della legislazione, inclusi i progetti preliminari, i giudizi, i rapporti di commissione, i documenti bianchi, ecc. L'interpretazione intenzionale comporta un rigetto della regola esclusiva. Il giurista israeliano Aharon Barak, vede l'interpretazione intenzionale come una costruzione legale, che combina elementi sia soggettivi che oggettivi. Barak afferma che gli elementi soggettivi includono l'intenzione dell'autore del testo, mentre gli elementi oggettivi includono l'intento dell'autore ragionevole e dei valori fondamentali del sistema giuridico.
