La surrogazione è la dottrina giuridica in base alla quale una persona assume i diritti oi rimedi di un creditore contro il suo debitore. I diritti della surrogazione possono essere presentati in due modi diversi: sia automaticamente come una questione di legge, sia mediante un accordo come parte di un contratto. La sostituzione per contratto si presenta più comunemente nei contratti di assicurazione. La subrogazione come questione di legge è una dottrina equa e fa parte di un più ampio corpo di legge conosciuto come arricchimento ingiusto. Le due aree più comuni in cui la perturbazione è rilevante sono l'assicurazione e le fideiussioni. In ogni caso, la premessa fondamentale è che quando una persona effettua un pagamento su un obbligo che, in diritto, è la responsabilità primaria di un altro soggetto, la persona che effettua il pagamento è subrogata alle domande della persona a cui hanno fatto la Pagamento in relazione a eventuali richieste o rimedi che siano esercitabili contro il soggetto prevalentemente responsabile.
