वैधानिक अटींमध्ये, एक अपील फक्त वैमनस्यासंबंधी प्रणाली वापरून सामान्य कायद्यानुसार फौजदारी खटल्यातील एखाद्याने केलेल्या दाव्याचा उत्तर आहे. संवादात्मक, एक याचिका आक्षेपार्ह एक प्रतिवादी द्वारे निर्णायक अर्थ आला आहे, किंवा अन्यथा फौजदारी आरोप प्रतिसादात, त्या व्यक्ती दोषी pleaded, नाही दोषी, नाही स्पर्धा किंवा Alford पुष्टी. दंडची संकल्पना सामान्य कायद्यानुसार आणि नागरी कायदा प्रणालीच्या अंतर्गत प्रक्रियांमधील गुन्हेगारी प्रक्रियेतील मुख्य फरकांपैकी एक आहे. सामान्य कायद्याअंतर्गत प्रतिवादीने दोषी ठरवलेला एक दंड आरोपींच्या गुन्ह्यांवरील खटल्याची सुनावणी घेतो आणि प्रतिवादीला ताबडतोब शिक्षा दिली जाऊ शकते. हे अमेरिकी कायद्यानुसार ज्ञात असलेली प्रणाली म्हणून अपील सौदा म्हणून तयार करते. नागरी कायद्याच्या न्यायाधिकारक्षेत्रात, सामान्यत: दोषींची याचिका नाही. आरोपी किंवा प्रतिवादीने दिलेल्या कबुलीजबाबाने पुराव्याच्या कोणत्याही दुसर्या भागासारखे मानले जाते आणि संपूर्ण कबूल केल्यामुळे पूर्ण चाचणीला रोखता येत नाही किंवा वादीने खटल्याची सुनावणी न्यायालयात ठेवण्याचे कर्तव्य टाळत नाही. एक "आंधळ पक्की" अशी याचिका दाखल केलेली दंड ठोठावण्यात आली आहे.
