Voluntariness एक कायदेशीर आणि तत्त्वज्ञानविषयक संकल्पना आहे ज्यात एखाद्या व्यक्तीच्या स्वतंत्र इच्छेची निवड केली जात आहे, जबरदस्तीने किंवा दडपशाहीमुळे निष्पन्न होण्यासारखे आहे. उदारमतवाद आणि स्वैच्छिकता यासारख्या तत्त्वज्ञानासह तसेच अनेक कायदेशीर यंत्रणा असा विश्वास करतात की त्या पक्षावर बंधनकारक होण्याकरता पक्षाने स्वेच्छेने सहमती दर्शविली पाहिजे. सामाजिक करार शासनाच्या स्वैच्छिक संमतीच्या संकल्पनेवर आधारित आहे. फौजदारी प्रक्रियेच्या फेडरल नियमांनुसार हे सिद्ध होते की "दोषी किंवा निलो दावेदारीची याचिका स्वीकारण्याआधी न्यायालयाने स्वतंत्रपणे प्रतिवादीला खुल्या न्यायालयात संबोधित केले पाहिजे आणि हे निर्धारित करणे स्वैच्छिक आहे आणि ते बळ, धमक्या किंवा आश्वासनांपासून निष्पन्न होत नाही." वास्तविक स्वैच्छिकता संशयास्पद आहे, कारण अभियोजकांना अधिक तुरुंगात वेळ मागण्याची धमकी देणे शक्य नाही तोपर्यंत आरोपींना दोषी ठरविण्यास सहमती दिली जाईल. या कारणास्तव, सामान्य कायदे न्यायालयांनी ऐतिहासिकदृष्ट्या दोषी pleasबद्दल नकारात्मक दृष्टिकोन घेतला.
