Badan kehakiman adalah sistem pengadilan yang menafsirkan dan menerapkan undang-undang atas nama negara. Badan kehakiman juga menyediakan mekanisme penyelesaian resolusi. Di bawah doktrin pemisahan kuasa, badan kehakiman umumnya tidak membuat undang-undang atau menguatkuasakan undang-undang, melainkan menafsirkan undang-undang dan menggunakannya untuk fakta-fakta setiap kes. Mahkamah dengan kuasa semakan kehakiman boleh membatalkan undang-undang dan peraturan negara apabila ia mendapati mereka tidak sesuai dengan norma yang lebih tinggi, seperti perundangan utama, peruntukan perlembagaan atau undang-undang antarabangsa. Hakim membentuk kekuatan kritikal untuk tafsiran dan pelaksanaan suatu perlembagaan, oleh itu secara de facto di negara-negara hukum umum yang membentuk badan undang-undang perlembagaan.
