W zachodnim prawie powszechnym legitymizacja jest statusem dziecka urodzonego rodzicom, którzy są prawnie małżonkowie; i dziecka poczętego przed rodzicami otrzymania legalnego rozwodu. Przeciwnie, nielegalność (lub bastardia) jest statusem dziecka urodzonego poza małżeństwem.
