Sądem jest system sądów interpretujących i stosujących prawo w imię państwa. Sądownictwo stanowi również mechanizm rozstrzygania sporów. Zgodnie z doktryną rozdziału władzy sądownictwo generalnie nie czyni prawa ani nie narzuci prawa, lecz interpretuje prawo i stosuje je do faktów każdego przypadku.
