Caso declarado
Em lei, um caso declarado é um procedimento pelo qual um tribunal pode solicitar a outro tribunal a sua opinião sobre uma questão de direito. Existem dois tipos: o caso consultivo declarado e o recurso por meio do caso indicado. Um caso consultivo declarado é feito a critério de um juiz antes que ele determine o caso no tribunal. Um apelo, no caso exposto, é feito a pedido de uma parte no processo para o juiz após a conclusão de um caso. Na audiência de um caso, o tribunal superior é restrito à consideração exclusiva da lei e é obrigado a aceitar a declaração de fatos submetida pelo tribunal de primeira instância. Se o pedido for concedido, o assunto será encaminhado para o tribunal superior. Isso geralmente assume a forma de "se tivéssemos / estivesse correto ..." e, em seguida, o aspecto específico da lei a que se refere o recurso. Se o pedido para declarar um caso for recusado, o requerente poderá solicitar reparação mediante revisão judicial. O Tribunal Superior determinará se a lei foi ou não corretamente aplicada. Se o recurso for confirmado, o Tribunal Superior remete o caso para o tribunal de magistrados apropriado com instruções para corrigir sua decisão.
