Criminalização
Criminalização ou criminalização, em criminologia, é "o processo pelo qual os comportamentos e os indivíduos são transformados em crimes e criminosos". Anteriormente, os atos legais podem ser transformados em crimes por legislação ou decisão judicial. No entanto, geralmente existe uma presunção formal nas regras de interpretação estatutária contra a aplicação retrospectiva de leis e somente o uso de expressões pelo legislador pode refutar essa presunção. O poder dos juízes para tornar nova lei e criminalizar retrospectivamente o comportamento também é desencorajado. De uma maneira menos aberta, onde as leis não foram rigorosamente aplicadas, os atos proibidos por essas leis também podem ser submetidos à criminalização de fato através de uma aplicação legal mais eficaz ou comprometida.
