A distinção comercial é um conceito importante na lei que rege marcas e marcas de serviços. Uma marca registrada pode ser elegível para registro, ou registrável, se ele executar a função de marca registrada essencial e possui um caráter distintivo. A inscrição pode ser entendida como um contínuo, com marcas "inerentemente distintivas" em uma extremidade, marcas "genéricas" e "descritivas" sem nenhum caracter distintivo na outra extremidade, e marcas "sugestivas" e "arbitrárias" entre esses dois pontos. As marcas "descritivas" devem adquirir distintivo através de um significado secundário - os consumidores passaram a reconhecer a marca como um indicador de origem - para serem protegidos. Os termos "genéricos" são usados para se referir ao produto ou serviço em si e não podem ser usados como marcas registradas.
