Capacidade (lei)
A capacidade das pessoas físicas e jurídicas determina se eles podem fazer alterações vinculativas em seus direitos, deveres e obrigações, como se casar ou se fundir, celebrar contratos, fazer presentes ou escrever uma vontade válida. A capacidade é um aspecto do status e ambos são definidos pela lei pessoal de uma pessoa: ▪ para pessoas físicas, a lei de domicílio ou lex domicilii em jurisdições de direito comum, e a lei de nacionalidade ou lex patriae, ou de residência habitual em direito civil estados; ▪ para as pessoas jurídicas, a lei do local de constituição, a incorporação da lex para as empresas, enquanto outras formas de entidade comercial derivam a sua capacidade, quer da lei do local onde foram constituídas, quer das leis dos estados em que estabelecem uma presença para fins de negociação, dependendo da natureza da entidade e das transações realizadas. Quando a lei limita ou impede uma pessoa de praticar atividades específicas, quaisquer acordos ou contratos para fazê-lo são anuláveis ou anulados por incapacidade.
