Recriminação

Na lei, a recriminação é uma defesa em uma ação de divórcio em que o acusado faz uma acusação semelhante contra a parte demandante. Em linguagem simples, é uma maneira de um advogado dizer: "Você também". A recriminação foi geralmente considerada pelos especialistas em direito da família como um dos aspectos mais disfuncionais e ilógicos do antigo sistema de divórcio baseado em falhas em países de direito comum. Por exemplo, no contexto de um casamento onde o relacionamento conjugal entrou em colapso ao ponto de ambos os cônjuges cometerem abertamente adultério, a afirmação de qualquer dos cônjuges desta defesa evitaria o divórcio mesmo que a unidade familiar não seja mais capaz de funcionar . Como resultado, a defesa foi formalmente abolida por estatuto em muitas jurisdições quando se converteram em um regime de divórcio sem culpa.
