Un proces nou sau rejudecarea cauzei este o reapariție a unui caz în instanță. În funcție de regulile jurisdicției, un nou proces poate apărea dacă: ▪ un juriu nu poate ajunge la un verdict; ▪ o instanță de judecată acordă propunerea unei părți pentru un nou proces, de obicei pe baza unui defect legal în procesul inițial; sau ▪ o instanță de apel inversă o hotărâre în circumstanțe care necesită reluarea cauzei. În unele cazuri sau în anumite sisteme juridice, în cazul în care partea care pierde într-o cauză face apel, atunci instanța de apel în sine va organiza un nou proces, cunoscut ca un proces de novo. În Statele Unite, dacă un inculpat este achitat de o infracțiune, al cincilea amendament interzice, în general, rejudecarea cauzei; astfel, cu câteva excepții, rejudecarea poate avea loc doar dacă verdictul din primul proces a fost "vinovat" sau dacă nu a existat verdictul. În alte sisteme juridice, regulile pot fi diferite.
