CASE STATED SÖZCÜĞÜ İNGILIZCE DİLİNDE NE ANLAMA GELİR?

Yasa uyarınca, bir dava, bir mahkemenin veya mahkemenin bir başka yoldan bir hukukun konusu hakkında görüş bildirmesini isteyen bir süreçtir. İki çeşit var: danışma davası açıldı ve davayla temyiz belirtildi. Belirtilen danışma davası, bir mahkemenin kararını vermeden önce bir hakimin takdirine bağlı olarak yapılır. Davanın yol açtığı itiraz, bir tarafın davanın yargılanması sonrasında hakime hitaben talebiyle yapılır. Bir dava üzerinde yapılan duruşmada, yüksek mahkeme yalnızca hukukun değerlendirilmesine kısıtlanmıştır ve alt mahkeme tarafından kendisine sunulan olgu bildirimini kabul etmesi gerekmektedir. Başvuru kabul edilirse, mesele üst mahkemeye yönlendirilir. Bu genellikle "biz / olabildiğinceiz ..." formunu ve daha sonra itirazın ilgili olduğu belirtilen hukuk alanını alır. Bir dava açma başvurusu reddedilirse, başvuran adli incelemeyle tazminat talep edebilir. Yüksek Mahkeme, yasanın doğru bir şekilde uygulanıp uygulanmadığını belirleyecektir. Temyiz kararı onaylanırsa, Yüksek Mahkeme kararı düzeltmek için dava dosyasını uygun sulh hukuk mahkemesine teslim edecek.
