Hukuk felsefesi, hukukun çalışma ve teorisidir. Hukuk teorisyenleri olarak da bilinen hukuk sisteminde çalışan akademisyenler hukukun, yasal akıl yürütmenin, yasal sistemlerin ve hukuk kurumlarının tabiatıyla ilgili daha derin bir anlayış elde etmeyi ummaktadır. Modern hukuk felsefesi 18. yüzyılda başlamış ve doğa hukuku, medeni kanun ve milletler hukukunun ilkelerine odaklanmıştır. Genel hukuk felsefesi hem akademisyenlerin cevaplamaya çalıştıkları sorunun türüne, hem de içtihat kuramlarına ya da düşünce okullarına göre bu soruları en iyi şekilde nasıl cevaplandıracağına göre kategorilere ayrılabilir. Genel hukuku ele alan çağın çağdaş felsefesi, sorunları iki kaba grupta ele almaktadır: ▪ Yasa ve hukuk sistemlerine özgü sorunlar. ▪ Varolduğu daha büyük siyasal ve toplumsal durumla bağlantılı olarak belirli bir sosyal kurum olarak hukukun sorunları. Bu soruların yanıtları, genel hukukta dört ilköğretim okulundan gelir: ▪ Doğal hukuk, yasama yöneticilerinin gücüne rasyonel nesnel sınırların var olduğu fikridir.
