Hukukun üstünlüğü, hukukun bir milleti yönetmesi gereken hukuk ilkesidir ve tek tek devlet görevlilerini değil. Öncelikli olarak, özellikle de hükümet yetkililerinin davranışları da dahil olmak üzere davranış üzerindeki kısıtlama olarak, toplum içindeki hukukun nüfuz ve yetkisine atıfta bulunmaktadır. Sözcük 16. yüzyıla kadar uzanılabilir ve 19. yüzyılda İngiliz hukukçusu A. V. Dicey tarafından yaygınlaştırılmıştır. Kavram, "Yasalar yönetmeli" yazan Aristoteles gibi eski filozoflara aşina oldu. Hukukun üstünlüğü, her vatandaşın kanun koyucuların kendileri de dahil olmak üzere kanunlara tabidir. Cetvelin, örneğin ilahi hak tarafından, yasanın üstünde olduğu fikrinin aksine durmaktadır. Hukukun üstünlüğü, politikacılar, hakimler ve akademisyenler tarafından geniş bir şekilde kullanılmasına rağmen "anlaşılmaz bir ayrım ayrımcılığı" yaratan "aşırı derecede anlaşılmaz bir kavram" olarak tanımlanıyordu ... herkes bunun içindeydi ancak ne olduğuna karşıt kanaatleri var.
