Визначення відхилення відрізняється від розпорядження тим, що це стосується закону, де розпорядження застосовуються до конкретних людей, яких торкається закон. З точки зору законодавства Європейського Союзу, відступ може також означати, що держава-член затримує реалізацію елемента регламенту ЄС до своєї правової системи протягом певного часу, наприклад п'ять років; або що держава-член вирішила не застосовувати конкретне положення у договорі через внутрішні обставини.
