В американському антимонопольній сфері монополізація є злочином, а основні категорії заборонених дій включають ексклюзивну торгівлю, цінову дискримінацію, відмову в постачанні основного об'єкта, прив'язку товару та хижі цінності. Монополізація є правопорушенням відповідно до розділу 2 Американського антимонопольного закону Шермана 1890 року. Він має специфічний юридичний сенс, який паралельно з "зловживанням" домінуючим становищем у законодавстві ЄС про конкуренцію, згідно зі статтею 102 Європейського Союзу.
