Criminalization

犯罪学的刑事定罪或刑事定罪是“行为和个人变成犯罪和罪犯的过程”。 以前的法律行为可以通过立法或司法裁决转变为犯罪。 然而,法律解释规则通常是根据追溯适用法律而进行的正式推定,只有立法机关使用明确的言论才能反驳这一推定。 法官制定新法律,追溯行为定罪的权力也是不鼓励的。 如果法律没有得到严格执行,那么这些法律所禁止的行为也可能通过更有效或者执法的方式实际上进行了刑事定罪。 Criminalization or criminalisation, in criminology, is "the process by which behaviors and individuals are transformed into crime and criminals". Previously legal acts may be transformed into crimes by legislation or judicial decision. However, there is usually a formal presumption in the rules of statutory interpretation against the retrospective application of laws and only the use of express words by the legislature may rebut this presumption. The power of judges to make new law and retrospectively criminalise behaviour is also discouraged. In a less overt way, where laws have not been strictly enforced, the acts prohibited by those laws may also undergo de facto criminalisation through more effective or committed legal enforcement.
