Derogation

减损是部分撤销法律,而不是废除或彻底废除法律。 该术语用于民法和普通法。 有时使用松散地意味着废除,就像在法律上一样:先验的后验,即后来的法律赋予了先前废除的权力。 减免与分配不同之处在于适用于法律,其中适用于受法律影响的特定人员。 在欧盟立法方面,减损也可能意味着一个成员国在某一特定的时间范围(如五年)将欧盟条例的要素拖延到其法律制度中; 或者由于内部情况,成员国选择不执行条约中的具体规定。 Derogation is the partial revocation of a law, as opposed to abrogation or the total abolition of a law. The term is used in both civil law and common law. It is sometimes used, loosely, to mean abrogation, as in the legal maxim: Lex posterior derogat priori, i.e. a subsequent law imparts the abolition of a previous one. Derogation differs from dispensation in that it applies to the law, where dispensations applies to specific people affected by the law. In terms of European Union legislation, a derogation can also imply that a member state delays the implementation of an element of an EU Regulation into their legal system over a given timescale, such as five years; or that a member state has opted not to enforce a specific provision in a treaty due to internal circumstances.
