Ein mündliches Gesetz ist ein Verhaltenskodex, der in einer bestimmten Kultur-, Religions- oder Gemeinschaftsanwendung verwendet wird, durch die ein Körper von menschlichen Verhaltensweisen durch mündliche Überlieferung und effektiv respektiert wird, oder die einzige Regel, die mündlich übermittelt wird. Viele Kulturen haben ein mündliches Gesetz, während die meisten zeitgenössischen Rechtssysteme eine formale schriftliche Organisation haben. Die mündliche Überlieferung ist das typische Instrument der Übermittlung der oralen Codes oder im allgemeineren Sinne der Komplex dessen, was eine Kultur unter den Generationen "von Vater zu Sohn" überträgt. Diese Art der Übertragung kann auf fehlende andere Mittel, wie in Analphabeten oder kriminellen Gesellschaften, zurückzuführen sein oder kann ausdrücklich von demselben Gesetz verlangt werden. Es gab eine kontinuierliche Debatte über die mündliche versus geschriebene Übertragung, mit dem Fokus auf die wahrgenommene höhere Zuverlässigkeit der schriftlichen Beweise, in erster Linie auf der Grundlage der "linearen Welt der Akademie", wo nur schriftliche Aufzeichnungen akzeptiert werden. Allerdings wurden "Standard" Theorien der Oralität und Alphabetisierung vorgeschlagen.
