Bei der Beweisbewegung handelt es sich um die vorsätzliche oder fahrlässige Zurückhaltung, Verbergung, Veränderung oder Zerstörung von Beweismitteln, die für ein Rechtsverfahren relevant sind. Spoliation hat zwei mögliche Konsequenzen: In den Rechtsgebieten, in denen die Handlung strafbar ist, kann es zu Geldstrafen und Inhaftierungen für die Parteien führen, die in der Sprengung tätig sind; In den Rechtsprechungen, in denen einschlägiger Rechtsprechungsvorschlag festgestellt worden ist, kann das durch Sprengungen möglicherweise veränderte Verfahren unter einer Sprengungsfolgerung ausgelegt werden. Die Sprengschlußfolgerung ist eine negative Evidenzfolgerung, die ein Finder der Tatsache aus der Zerstörung eines Dokuments oder einer Sache, die für ein laufendes oder vernünftigerweise vorhersehbares Zivil- oder Strafverfahren relevant ist, ziehen kann: Der Finder der Tatsache kann alle Beweise, die in so stark aufgedeckt sind, überprüfen Ein Licht wie möglich gegen den Spoliator und zugunsten der Gegenpartei. Die Theorie der Spoliation Schlußfolgerung ist, dass, wenn eine Partei Beweise zerstört, kann es vernünftig zu schließen, dass die Partei hatte "Bewusstsein der Schuld" oder andere Motivation, um die Beweise zu vermeiden. Daher kann der Faktor zu dem Schluss kommen, dass der Beweis für den Spoliator ungünstig gewesen wäre.
