An appeal is, according to German law, the formalized challenge of a state decision, in particular a judicial decision, with a view to the abolition or amendment. While in Austria and Switzerland legal remedies constitute the legal-language collective term for any contestation of a decision, the appeal is, according to German law, a special remedy with a suspension effect and a devolution effect. Furthermore, the definition in the right to the right of citizenship is that, in addition to appeal, revision and appeal against judicial decisions, legal remedies in the sense of § 839 para. 3 BGB (German Civil Code) also cover all other remedies against an administrative action which are capable of defending the alleged offenses. This also includes remembrance, opposition, objection to an administrative act and a duty to service supervisor.
