WHAT DOES A CONTO MEAN IN POLISH?

Zadatek

Deposit - additional contractual reservation. It serves to protect the interests of both parties to the contract. A party who fails to fulfill its obligation will lose the deposit if it has given it itself or is required to return it in double amount. Since 2008, the payment is effective if it is given before, during or after the contract. The sum can be expressed in money as well as movable item. The amount of the deposit should not exceed the value of the future liability. The deposit is most often used in preliminary contracts. Thanks to this, each party secures itself in the event of a last minute breach of contract by the other party. The deposit differs from the advance payment in that, in the event of non-performance by one of the parties, the other party is enriched by the amount of the deposit; The down payment is simply returned without any additional consequences. The deposit becomes only when it is clearly stated in the contract - without such a term will be an advance. The most common scenario: the buyer, entering into a preliminary contract, pays the seller a deposit.

Zadatek – dodatkowe zastrzeżenie umowne. Służy do zabezpieczenia interesów obu stron umowy. Strona, która nie wykona swojego zobowiązania traci zadatek, jeśli sama go dała, albo obowiązana jest go zwrócić w dwukrotnej wysokości. Od 2008 roku zadatek jest skuteczny jeżeli zostanie wręczony przed, w trakcie lub po zawarciu umowy. Zadatkiem może być określona suma wyrażona w pieniądzu jak również rzecz ruchoma. Wysokość zadatku nie powinna przekraczać wartości przyszłego zobowiązania. Zadatek jest najczęściej stosowany w umowach przedwstępnych. Dzięki niemu każda ze stron zabezpiecza się na wypadek zerwania umowy w ostatniej chwili przez drugą stronę. Zadatek różni się od zaliczki tym, że w razie niewykonania umowy przez jedną ze stron, druga strona wzbogaca się o wysokość zadatku; natomiast zaliczka jest po prostu zwracana, bez dodatkowych konsekwencji. Zadatek staje się nim tylko wtedy, gdy zostanie to jasno określone w umowie – bez takiego określenia będzie to zaliczka. Najczęstszy scenariusz: kupujący, zawierając umowę przedwstępną, płaci sprzedającemu zadatek.
