Halacha

Halacha - in Judaism an authentic and authoritative interpretation of the Mosaic Law, showing how to apply the Law to specific life situations. This is the whole set of religious commandments that is one of the three main branches of Jewish oral tradition - formerly used as a plural halachot - either the chosen interpretation or the opinion of one of the rabbis, considered to be valid for the practice. Talks in the Talmud say that the rabbi N.'s opinion is halach, which means that the Rabbi's opinion on the subject is decisive. Halacha is a form of midrash. The basic set of halachic legal solutions is Mishna, existing in the form written from the 2nd century after Chr. We find them also in Tosefta, in the part containing midrashes halak and in Talmud. The halakic tradition is constantly being developed in the religious community of Judaism. Later codifications can be found. in Shulchan Aruch and rabbinic responsach, and in local traditions. Halacha – w judaizmie autentyczna i autorytatywna wykładnia Prawa Mojżeszowego, ukazująca jak stosować Prawo do konkretnych sytuacji życiowych. Tą nazwą określa się bądź cały zbiór przykazań religijnych stanowiący jedną z trzech głównych gałęzi żydowskiej ustnej tradycji – dawniej używano do niego liczby mnogiej halachot – bądź poszczególną wybraną interpretację lub opinię któregoś z rabinów, uznaną za obowiązującą dla danej praktyki. W Talmudzie można spotkać wyrażenie, że halachą jest opinia rabina N., co znaczy, że opinia tego rabina na dany temat jest rozstrzygająca. Halacha jest formą midraszu. Podstawowym zbiorem halachicznych rozstrzygnięć prawnych jest Miszna, istniejąca w formie pisanej od II w. po Chr. Znajdujemy je także w Tosefcie, w części zawierającej midrasze halachiczne, oraz w Talmudzie. Tradycja halachiczna jest w religijnej społeczności judaizmu stale tworzona. Późniejsze kodyfikacje można znaleźć m.in. w Szulchan Aruch i responsach rabinicznych, oraz w lokalnych tradycjach.
