QUÉ SIGNIFICA CASE STATED EN INGLÉS
Caso declarado
En la ley, un caso es un procedimiento por el cual un tribunal puede pedir a otro tribunal su opinión sobre un punto de la ley. Hay dos tipos: caso consultivo declarado y apelación a modo de caso. Un caso consultivo es declarado a discreción de un juez antes de que él o ella determine el caso ante el tribunal. Un recurso de casación se presenta a petición de una parte en el procedimiento ante el juez después de la conclusión de un caso. En la audiencia de un caso declarado el tribunal superior se limita a la consideración de la ley por sí solo y está obligado a aceptar la declaración de los hechos que le son presentados por el tribunal inferior. Si la solicitud es concedida, el asunto se remite a la corte superior. Esto generalmente toma la forma "¿estábamos / estaba yo correcto ..." y luego el aspecto específico del derecho al que se refiere el recurso. Si la solicitud de denegación de un caso es rechazada, el solicitante podría solicitar una reparación judicial. El Tribunal Superior determinará si la ley se aplicó correctamente o no. Si la apelación es confirmada, la Corte Suprema remitirá el caso al tribunal de magistrados apropiado con instrucciones para corregir su decisión.
