En los sistemas jurídicos de derecho consuetudinario, un precedente o autoridad es un principio o regla establecido en un caso legal anterior que es vinculante o persuasivo para un tribunal u otro tribunal al decidir casos posteriores con asuntos o hechos similares. El principio general en los sistemas legales de derecho consuetudinario es que los casos similares deben ser decididos para dar resultados similares y predecibles, y el principio de precedente es el mecanismo por el cual se alcanza ese objetivo. Black's Law Dictionary define el "precedente" como una "regla de derecho establecida por primera vez por un tribunal para un determinado tipo de caso y posteriormente se hace referencia en la decisión de casos similares". El precedente de common law es un tercer tipo de ley, en pie de igualdad con la ley estatutaria y la ley reguladora. Stare decisis es un principio jurídico por el cual los jueces están obligados a respetar el precedente establecido por decisiones anteriores. Las palabras se originan de la formulación del principio en la máxima latina Stare decisis et non quieta movere: "estar de pie por decisiones y no molestar a los no perturbados.

The general principle in common law legal systems is that similar cases should be decided so as to give similar and predictable outcomes, and the principle of precedent is the mechanism by which that goal is attained. Black's Law Dictionary defines "precedent" as a "rule of law established for the first time by a court for a particular type of case and thereafter referred to in deciding similar cases." Common law precedent is a third kind of law, on equal footing with statutory law, and regulatory law. Stare decisis is a legal principle by which judges are obliged to respect the precedent established by prior decisions. The words originate from the phrasing of the principle in the Latin maxim Stare decisis et non quieta movere: "to stand by decisions and not disturb the undisturbed.
