Impracticabilidad
La doctrina de la impracticabilidad en el derecho consuetudinario de los contratos excusa el cumplimiento de un deber, cuando ese deber se ha convertido en imposible o difícil para la parte que debía desempeñar. La impracticabilidad es similar en algunos aspectos a la doctrina de la imposibilidad porque se activa por la ocurrencia de una condición que impide que una parte cumpla el contrato. La diferencia principal entre las dos doctrinas es que mientras la imposibilidad excusa el desempeño donde el deber contractual no puede ser físicamente realizado, la doctrina de la impracticabilidad entra en juego donde el rendimiento es físicamente posible, pero sería muy oneroso para el partido cuyo desempeño se debe. Por lo tanto, la imposibilidad es una condición objetiva, mientras que la impracticabilidad es una condición subjetiva que un tribunal debe determinar.
