En la ley inglesa, el encarcelamiento es la restricción de la libertad de una persona. El libro Termes de la Ley contiene la siguiente definición: El encarcelamiento no es otra cosa que la restricción de la libertad de un hombre, ya sea en campo abierto, o en las poblaciones, o en la jaula en las calles o en la casa de un hombre , Así como en las prisiones comunes; Y en todos los lugares se dice que el partido tan restringido es un prisionero, siempre y cuando no tenga libertad para ir en todo momento a todos los lugares a donde quiera sin libertad bajo fianza, o de otra manera. Este pasaje fue aprobado por Atkin y Duke LJJ en Meering v Grahame White Aviation Co. It is not imprisonment to prevent a person from proceeding along a particular way if it is possible for him to reach his intended destination by another route. Imprisonment without lawful cause is a tort called false imprisonment. Imprisonment is a type of sentence.
