Contratos reales en derecho romano
En derecho romano, los contratos podían dividirse entre aquellos en re, los que eran consensuales, y los que eran contratos innominados en derecho romano. Aunque Gayo sólo identifica un único tipo de contrato en re, comúnmente se piensa que había cuatro, como Justinian identifica: mutuum, commodatum, depositum y pignus. Cada uno variaba sobre los estándares esperados de la atención, la transferencia de la propiedad, y otros aspectos prácticos que se derivan del propósito de cada uno. Todos ellos involucraron la entrega o una cosa física, que es una característica definitoria. En general, se complementaban con el contrato de estipulación y nombramiento, que permitía añadir disposiciones adicionales tales como intereses a los contratos, haciéndolos más adecuados para aplicaciones comerciales.
