Matrimonio putativo
Un matrimonio supuestamente válido es un matrimonio aparentemente válido, celebrado de buena fe por parte de al menos uno de los socios, pero que es jurídicamente inválido debido a un impedimento técnico, como un matrimonio preexistente por parte de uno de los socios. A diferencia de alguien en un matrimonio de derecho consuetudinario, estatutario o ceremonial, un esposo putativo no está legalmente casado. En cambio, un cónyuge putativo se cree casado de buena fe y se le dan derechos legales como resultado de la confianza de esta persona en esta creencia de buena fe. Los matrimonios putativos existen tanto en el derecho canónico católico como en diversas leyes civiles, aunque las reglas pueden variar. En algunas jurisdicciones, los matrimonios putativos son una cuestión de jurisprudencia más que de legislación. En muchas jurisdicciones, bajo el derecho civil, el matrimonio se convierte en válido si se elimina el impedimento.
